UPMedical OÜ, registry code 16042130, address Seedri 6, Pärnu 80010 (hereinafter UPMedical), manages the health consultation environment www.upmedical.eu/medical-consultation (hereinafter “online medical service page”), where you can request medical assistance. to consume advice and health news and articles.

A person designated as “User” or “you” who uses the services and/or content provided on the medical services page of the website, including without creating a separate user account (it is possible to remain anonymous). By using the portal, the user confirms that he has carefully read the terms of use and agrees that the terms of use are legally binding. The Website’s Medical Services Page Services Terms constitute a binding agreement between you and UPMedical (“Agreement”) governing your need for the Website’s Medical Services Page Services.

1. WEBSITE MEDICAL SERVICES PAGE AND USE OF ITS SERVICES

1.1. The medical services page of the website is a user consultation environment through which the user can receive health advice from top doctors, read health articles, news and health advice and use other services offered on the website.

1.2. Information provided through the Medical Services page of the Website, including health advice from a physician, is for informational purposes only and is not a substitute for regular or emergency medical examination. As a result of the foregoing, the UPMedical website is not responsible for the correctness, accuracy, completeness or timeliness of the information published on the medical service page (including doctor’s recommendations and diagnoses, even if issued).

2. USER APPROVALS, RIGHTS AND OBLIGATIONS

2.1. UPMedical grants you a limited license to the Medical Services page of the Website subject to the terms set forth in this Agreement. You understand and acknowledge that the Medical Services page of the Website is owned and operated by UPMedical. You agree that your use of the Medical Services page of the Website does not grant you any ownership rights in the content of the Medical Services page of the Website.

2.2. Visitors to the medical service page of the website are obliged to follow the rules set forth in clause 2.4 of the UPMedical agreement when posting questions.

2.3. Due to the fact that the services of the medical service page of the website may be paid, the User undertakes to pay UPMedical for the paid service, if it is provided in accordance with clause 4 of this agreement.

2.4. User is prohibited:

2.4.1. Use the Medical Services page of the Website for fraudulent or other illegal purposes;

2.4.2. Harass, abuse, insult, harm defame, defame, disparage, threaten or discriminate on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin or disability;

2.4.3. Send spam;

2.4.4. Use the Medical Services page of the Website for indecent or immoral purposes;

2.4.5. Upload or transmit viruses or other types of malware that are or may be used in a way that affects the functionality or operation of the Medical Services page of the Website;

2.4.6. Create databases or lists of users of the Website’s medical services pages for any purpose;

2.4.7. Post medical service page questions on the website that are meaningless or off-topic;

2.4.8. Publish questions on the medical service page of the website under the name of another person, including publishing other personal data of another person, such as personal identification number, address, contact information or information about health status;

2.4.9. Post questions on the Medical Services page of the Website that are offensive, threatening, defamatory, malicious, incite physical or psychological violence, or otherwise promote illegal activity. Among other things, the User is prohibited from using uncensored expressions, spreading falsehood or unjustifiably denigrating other persons when making posts;

2.4.10. Post questions on a website’s medical services page that contain off-topic links or advertisements.

2.5. The User understands that UPMedical has the right to delete a question published by the User on the Portal, which is contrary to the terms of this agreement, good manners or valid legislation. At the same time, the User understands that UPMedical does not undertake to provide the User with a reason for deleting the question.

3. SERVICE FEE

3.1. The use of services on the medical services page of the website is subject to a fee. For example, asking a medical specialist a health-related question may be chargeable. In this case, you will be informed of the obligation to pay the fee and the amount of the fee before you are allowed to ask a question.

3.2. The service fee is paid by bank transfer.

3.3. UPMedical reserves the right to change the amount of the fee for an objective reason, e.g. if tax rates, service fees, maintenance fees etc. change. Updated fee rates are published on the medical service page of the website.

4. LIABILITY AND INDEMNIFICATION

4.1. The content, service and features made available in connection with or through the Website medical service page are provided on an “as is” and “as available” basis, without warranties of any kind. UPMedical disclaims all warranties to the fullest extent permitted by applicable law.

4.2. UPMedical does not guarantee or warrant that the website medical service page is compatible with any hardware and software you use, is always available or available at any particular time, functions without interruption at all times, is secure and error-free.

4.3. UPMedical is not responsible for, among others, but not exclusively, the following circumstances:

4.3.1. for the correctness, accuracy, completeness, topicality, validity and legality of any information published on the website medical service page, regardless of whether the corresponding information is published as an article, news or as a response provided by a doctor;

4.3.2. for any consequences due to following the health advice published on the Website medical service page;

4.3.3. Any interruption, stoppage, suspension or other unavailability of the Website medical service page or the service provided therein;

4.3.4. Any program bugs, viruses, Trojan horses, etc. that anyone may transmit to or through the Website medical service page or the service provided therein;

4.3.6. Deletion of any content or data or inability to store any content or data;

4.3.6. Incompatibility of the technical means used to access the website medical service page;

4.3.7. For the behavior of users Website medical service page.

4.4. UPMedical is not responsible for any violation you have committed against third parties, including violation of personal rights due to a post with derogatory content. You fully understand that when publishing any content on the Website medical service page (e.g. giving an answer, asking a question), you are the publisher of the respective content, therefore you are solely responsible for the published content.

4.5. You agree to indemnify UPMedical against all costs, damages, claims and expenses (including legal fees) arising directly or indirectly from your breach of the provisions of the Agreement or any applicable law.

5. MISCELLANEOUS

5.1. UPMedical has the right to relocate data on the website for better use of the Website medical service page, e.g. to move questions to different categories for better monitoring. UPMedical also reserves the right to distribute User questions among specialists in the same field.

5.2. UPMedical reserves the right to change or supplement the conditions set forth in this Agreement at any time by publishing the updated user conditions on the Website medical service page.

5.3. The fact that UPMedical does not demand the performance of any provision or does not exercise any of its rights under the Agreement does not mean that UPMedical has waived the demand for performance of that provision or the exercise of the right in the future.

5.4. The law of the Republic of Estonia applies to the contract.

5.5. Disputes arising from the use of the portal are tried to be resolved through negotiations. if no agreement is reached, the dispute will be resolved in Pärnu County Court.

 

CANCELLATION POLICY

We understand that unforeseen circumstances may arise, and you might need to cancel your consultation with our menopause expert. This policy outlines the cancellation process, associated fees (if applicable), and important considerations.

Cancellation Options:
  • Phone & Video Call Consultations: To cancel your phone or video call consultation, please contact our customer service team as soon as possible, but no later than 48 hours before your scheduled appointment. You can reach us by email at support@upmedical.eu. Our team will guide you through the cancellation process and answer any questions you may have.

Please note: We are unable to offer cancellations for email Medical Expert consultations and Medical Expert Q&A service, due to the asynchronous nature of this format. Once your question is submitted, it is immediately routed to the expert for review and response.

  • Online Booking (if applicable): Depending on our system capabilities, you might be able to cancel your appointment directly through the online booking calendar (if you have an account). Look for a “Cancel Appointment” or similar option.
Cancellation Fees:
  • Early Cancellations: Cancellations made at least 48 hours before your scheduled phone or video call consultation will have no cancellation fee.
  • Late Cancellations Within 48 Hours: Cancellations made within 48 hours before your scheduled phone or video call consultation will incur a cancellation fee of 50% of the total consultation cost. This fee helps us cover administrative costs and ensure efficient scheduling for our experts.
  • No Show: If you miss your scheduled phone or video call consultation without prior notice (no show), the full consultation fee will be charged.
  • Email Consultations/Expert Q&A service: No cancellation fee applies to email consultations as the service is initiated upon submission of your question.

In accordance with the Debt Law the cancellation fee must be transferred to the current account of UPMedical OÜ Swedbank IBAN  EE272200221074858151 with the explanation: “Deductible fee for Medical Expert Service”.

We recommend reviewing this policy before booking your consultation. The cancellation policy may also be available on our website or during the online booking process. Understanding the policy in advance will help you make informed decisions.

Early Cancellation Recommended:

Cancelling your consultation with sufficient notice, especially for phone and video calls, allows us to offer the appointment slot to another patient in need. This ensures efficient use of our expert’s time and helps us serve more women seeking menopause guidance.
